Independent Istanbul Member of Parliament and lawyer Mustafa Yeneroğlu issued a stark assessment of Turkey's penal justice system, warning that the country’s rapidly expanding prison population is indicative of a deep-seated structural crisis within the judiciary.

Yeneroğlu's analysis, supported by 2025 data from the international World Prison Brief (WPB), highlights that Turkey's incarceration rate of 488 per 100,000 people has reached nearly four times the European average.

The MP stated via social media: “Turkey has reached almost four times the European average with 488 inmates/convicts per 100,000 people. Today, while streets are filled with criminals released due to lack of prison capacity, jails are filled with tens of thousands of people subjected to the injustice of the ruling power.”

WPB Data Confirms Prison Overcrowding

The WPB (PrisonStudies.org), which tracks prison statistics globally, published data in its September 2025 report statistically confirming the crisis Yeneroğlu highlighted:

Germany Comparison and Systemic Failure

Yeneroğlu presented a dramatic comparison to underscore the severity of the situation: Turkey, with over 428,000 people in prison (November 3, 2025 data), houses eight times the number of inmates found in Germany (59,413), despite both countries having similar populations.

"This difference stems not from the crime rate, but from the justice system," Yeneroğlu asserted, pointing to a systemic, rather than social, problem.

Alarming Pre-trial Detention Rate

The MP noted that 65,108 people—14.9% of the total prison population—are pre-trial detainees, stating that detention has become a routine practice rather than an exception.

Yeneroğlu argues this condition points to two fundamental truths: an unjust social order is producing more criminals, and an unjust judicial system is filling prisons with innocent people.

Warning on Non-Compliance

Concluding his warning, Yeneroğlu stressed that the situation will only worsen unless Turkey fundamentally reforms its judicial policies:

“Unless we truly transform our judicial system into one that delivers justice, and unless you implement the rulings of the ECtHR and the Constitutional Court (AYM), we will continue to fill prisons with innocent people.”

According to WPB historical data, Turkey's prison population has increased eightfold in the last 25 years, rising from 49,512 in 2000 to 419,194 in 2025.
